In another victory for the right of a trial by jury, the Oklahoma Supreme Court struck down a nursing home arbitration agreement. In Johnson v. Convalescent Center of Grady County, LLC, 2014 OK 102, the Supreme Court held that if an arbitration agreement is signed by a representative who does not have the authority to sign such an agreement, the arbitration agreement is not enforceable.
This decision preserves the ability of Oklahoma families to use their Constitutionally-protected right to a trial by jury to hold nursing homes accountable for any abuse and injuries they cause.
